Fishburn shooting trial moves to Porter Co. 8/20/2009
Porter County has been selected as the trial venue in the shooting of an Indianapolis police officer, the Marion County prosecutor said today. Brian Reese, 37, is accused of shooting officer Jason Fishburn in the head in July 2008 during a foot chase on Indianapolis’ Eastside. Reese’s attempted murder trial had been set for this month in Marion Superior Court, but the judge granted a defense motion to move the trial out of the county because of concerns extensive publicity had tainted the jury pool.
Now Reese will go on trial Nov. 2 in Porter County Circuit Court in Valparaiso, Prosecutor Carl Brizzi said, with the proceedings expected to last more than a week. The Northwest Indiana county is on Lake Michigan, just east of Gary. Judge Lisa Borges is awaiting a stipulation from both parties before issuing an order finalizing Porter County’s selection.
